I think the devs would try to apeal to the lowest common denominator on this one, if they are allways cutting away a chunk of there market by making it only Vista, or needing super high PC specs they wouldnt make any money. They also mention in the FAQ that their going to be developing it using the new unreal engine which has good stability on high and low end machines, logically, delivering something that will only run on a top of the range machine wouldnt be a financially viable business solution. I would expect to see lots of 'pretty' options which can be turned off on a lower spec machine to keep the gameplay at an acceptable level.
As for DirectX10, who knows.. I program in DX9 and havent even looked at 10 yet simply because it has a totally different graphical pipeline, and most PC's wont even be able to get the best out of it just yet, but saying that if it does use DX10 it doesnt mean you will need to have vista afaik.
